PT. Tanaco Jaya Utama/Rudi Sutanto s Lawsuit Is Refused

There has been a legal connection between PT. Bank Permata, Tbk. as creditor and PT. Tanaco Jaya Utama as debtor, in relation with the credit facilities given by PT. Bank Permata, Tbk. to PT. Tanaco Jaya Utama/Rudi Sutanto based on Loan Agreement which was made by The Parties. PT. Tanaco Jaya Utama/ Rudi Sutanto has put up security for the fulfillment of credit facilities to PT. Bank Permata, Tbk. in the form of land with the Right of Ownership No. 01138/Jatimulya which was burdened by Mortgage under The Deed of Mortgage No. 63/2004 dated on 2nd of April 2004 Jo. Mortgage Certificate No. 15th of April 2004, along the building on it. For the fulfillment of obligations to PT. Bank Permata, Tbk., there has been an auction to execute the mortgage object. Based on the said matters, PT. Tanaco Jaya Utama/Rudi Sutanto has submitted Tortius Act Lawsuit through Tangerang District Court as registered in Case Number 355/Pdt.G/2008/PN.Tgn.,PT. Bank Permata, Tbk has appointed Novian & Partners as the attorney at law. On 8th of June 2009, The Counsel of Judges of Tangerang District Court has given decision, in which stated: 1. Refused the entire Plaitiffs Lawsuit 2. Punished the Plaintiff to pay the case administration fee amounting to Rp. 416.000,- (four hundred and sixteen thousand rupiah)
