There has been a legal relationship between PT. Nindya Karya (Persero) (contested party) with PT. Cendrawasih Buana Citranusa Utama (contesting party). And for securing obligation fulfillment to PT. Nindya Karya (Persero)., PT. Cendrawasih Buana Citranusa Utama had given guarantee that has been encumbered with mortgage in form of SHM No. 1554/Cipete Selatan, SHM No. 807/Cipete Selatan and SHM No. 2283/Cipete Selatan. There was a fact that PT. Cendrawasih Buana Citranusa Utama had committed default (breach of contract), and PT. Nindya Karya (Persero) had given reprimand to PT. Cendrawasih Buana Citranusa Utama in order to make the company fulfilled all of its obligation, yet PT. Cendrawasih Buana Citranusa Utama did not have good will to fulfill all of its obligation. On November 30, 2009 PT. Cendrawasih Buana Citranusa Utama had filed Challenge/objection through South Jakarta District Court related to stipulation on execution auction of Head of East Jakarta District Court and Head of South Jakarta District Court. And to represent its legal interest, PT. Nindya Karya (Persero) had appointed Novian & Partners as its legal consultant
