There has been legal relationship between PT. Kelsri and Parama Matra Widya with PT. Pelabuhan Penajam Banua Taka related to Design and Build of Eastkal Supply Base in Penajam Paser Utara, East Kalimantan, as mentioned in Agreement No. 001/PPBT/CONT/VII/2007 Jo. Amendments and Additions. On August 11, 2010, PT. Kelsri (Plaintiff I) and PT. Parama Matra Widya (Plaintiff II) filed lawsuit based on Default against PT. Pelabuhan Penajam Banua Taka through Balikpapan District Court, as registered in Case No. 93/Pdt.G/2010/PN.Bpp. And to represent their legal interest as Defendant as in Case No. 93/Pdt.G/2010/PN.Bpp., PT. Pelabuhan has appointed Novian & Partners as the Attorney at Law. In trial held on September 29, 2010, Novian & Partners as the Attorney at Law of PT. Pelabuhan Penajam Banua Taka (Defendant) submitted Exception of Absolute Competency. On October 29, 2010, The Counsel of Judges of Balikpapan District Court gave the Verdict of such Case No. 93/Pdt.G/2010/PN.Bpp., which stated to accept the Exception of Absolute Competency from Defendant and stating that Balikpapan District Court has no jurisdiction to examine such case.
