THE HIGH COURT OF THE BANTEN AGENCY REAFFIRMED THE DECISION OF THE PANDEGLANG AGENCY IN CASE No. 405/Pdt.G/2022/PA.Pdlg.

Against the Decision of the Pandeglang Religious Court No. 405/Pdt.G/2022/PA.Pdlg dated October 16, 2023, Entong Yahya Bin Suminta Dkk have filed an appeal through the Banten Religious High Court.

In the Appeal process, Novian & Partners (who is also the Attorney of Pandeglang Regency Government) has been granted Power of Attorney by Sukamaju 1 State Elementary School, Labuan Sub-district (1st Respondent) and Sukamaju Village Head (2nd Respondent) to represent the legal interests of 1st Respondent and 2nd Respondent as registered in Case Register No. 99/Pdt.G/2023/PTA.Btn at Banten Religious High Court.

On December 21, 2023, the Panel of Judges of the Banten Religious High Court has given a Decision on case No. 99/Pdt.G/2023/PTA.Btn with the following rulings: Affirming the Decision of the Pandeglang Religious Court Number 405/Pdt.G/2023/PA.Pdlg., dated October 16, 2023 AD coinciding with the date 1 Rabiul Akhir 1445 Hijri;

with legal considerations including:

• That the evidence and two witnesses of the Plaintiffs/Appellants cannot prove the arguments of the lawsuit to strengthen their interests, and the Plaintiffs/Appellants lawsuit is not at all supported by the facts of their inheritance. On the contrary, the Defendants have proven that the process of issuing the Deed in lieu of the Deed of Pledge of Waqf Number: W3/6/D14/KD of 1990 dated May 29, 1990 was in accordance with the sharia and applicable laws and regulations.
