On November 23rd, 2009, Otong Djalihin (The Plaintiff) filed a Resistance Lawsuit against PT. Bank Permata, Tbk (1st Defendant) and Tangerang State Assents and Auctions Sevice Office (KPKNL) (2nd Defendant) through The Registrar of Tangerang District Court. Such Lawsuit is based on the objection of Sdr. Otong Djalihin towards the execution of auction upon mortgage and to represent the legal interest on such case, PT. Bank Permata, Tbk has appointed Novian & Partners as legal Attorney. On June 21st, 2010, The Council of Judges of Tangerang District Court gave The Judgment of Case Num. 415/Pdt.G/2009/PN.TNG which stated among others to grant the Lawsuit by The Plaintiff for whole part. In appeal process at Banten Hight Court on June 14th, 2011, The Council of Judges gave the Judgment of Case Num. 29/PDT/2011/PT.BTN which stated to affirm The Judgment by Tangerang District Court Num. 415/Pdt.Bth/2009//PN.TNG. In Cassation process, The supreme Court Republic of Indonesia gave Their Judgment Num. 1915 K/PDT/2012 dated on April 30th, 2013 which stated to : 1. Grant The Submission for Cassation by The Applicant The Head of Tangerang State assets and Auction Service Office (KPKNL); 2. Annul the Judgment of Banten High Court Num. 29/Pdt/2011/PT.Btn dated on June 14th, 2011 which affirmed The Judgment by Tangerang District Court Num. 415/Pdt.Bth/2009/PN.Tng dated on June 21st, 2010.
