PT. Bank Permata, Tbk through Novian & Partners filed The Petition for Annulment of Amicable Settlement against PT. Total Makmur Arto through The Commercial Court at Central Jakarta District Court as on Case Num. 01/Pdt.Sus/Pemb.Perdamaian/2013/PN.Niaga.Jkt.Pst, due PT. Total Makmur Arto was default to perform The Agreement of Amicable Settlement dated on July 21st, 2011 which has obtained legalization/Homologation as in Judgment Num. 18/PKPU/2011/PN.Niaga.Jkt.Pst dated on July 21st, 2011. On July 4th, 2013, The Council of Judges of The Commercial Court at Central Jakarta District Court gave The Judgment Num. 01/Pdt.Sus/Pemb.Perdamaian/2013/PN.Niaga.Jkt.Pst in conjunction with Num. 18/PKPU/2011/PN.Niaga.Jkt.Pst which stated as follows: 1. State that PT. Total Makmur Arto was default to perform the contents of Amicale Settlement as in Judgment by The Commercial Court at Central Jakarta District Court Num. 18/PKPU/2011/PN.Niaga.Jkt.Pst dated on July 21st, 2011 and with all its legal consequences. 2. State that The Agreement of Amicable Settlement dated on July 21st, 2011 between PT. Total Makmur Arto and The Creditors which was legalized by The Judgment of The Commercial Court at Central Jakarta District Court Num. 18/PKPU/2011/PN.Niaga.Jkt.Pst dated on July 21st, 2011 is null; 3. State that PT. Total Makmur Arto, which is residing at Bekasi St. Kp. Payangan, Gg. Walet RT.007 Rw.006 Jatisari Village Jatiasih Sub District, City of Bekasi West Java or St. Ouri Tunggal Num. 88 Rt.04, Rw.07 Harjamukti Village, Cimanggis Sub district City of Depok, West Java is bankrupt with all its legal consequences.
