There is a legal relationship between PT. Bank CIMB Niaga, Tbk., as creditor with PT. Genta Ardia Abadi as Debitor in connection with the credit facility given by PT. Bank CIMB Niaga, Tbk. to PT. Genta Ardia Abadi as Credit Agreements made by The Parties. PT. Genta Ardia Abadi had given guarantees to PT. Bank CIMB Niaga, Tbk., such of land with rights of ownership certificate No. 384/Jelambar Baru, and certificate No. 474, 751, 1054, and 7503/Rawa Buaya together with building built on it. Since PT. Genta Ardia Abadi had not fulfilled the payment obligation of the credit facility that had been given by PT. Bank CIMB Niaga, Tbk., therefore PT. Bank CIMB Niaga, Tbk., had submitted petition to execute mortgage towards the mortgage object. Dated on February 16th, 2004 PT. Genta Ardia Abadi had submitted dobjection/denial through West Jakarta District Court as registered on case No. 059/Pdt.G/2004/PN.JKT.BAR., which put PT. Bank CIMB Niaga, Tbk., as the callenged/petitioned party. Dated on July 19th, 2004, Council of Judges of West Jakarta District Court had decided case as registered on case No. 059/Pdt.G/2004/PN.JKT.BAR., which decide Contesting Party I, II, III and IV are Unlawful Contesting Party. On the appeal process at DKI Jakarta Higher Court, dated on August 12nd , 2008, Council of Judges of DKI Jakarta High Court had given decision as defined at Decision No. 289/PDT/2008/PT.DKI., which affirm West Jakarta District Court Decision No. 059/Pdt.G/2004/PN.JKT.BAR., dated on February 16th, 2004.
